APPEAL PROBABLE.
CLAIM BY W. D. JOYSNAR. (By Telegrapn.—Own Correspondent.) GISBORNE, this day. An intimation that lie proposes to appeal against the judgment of Mr. Justice Blair in respect to his claim for £137,000 against the National Bank cif New Zealand was made by Mr. W. D. Lysnar, the plaintiff in litigation which lias occupied the attention of the Supreme Court and the Court of Appeal in New Zealand and also of the Privy Council during the past two or three years. Mr. Justice Blair's judgment was given in Wellington on Wednesday. The possibility of the Court of Appeal being invoked to review liis judgment was foreshadowed by the judge at a recent Supreme Court hearing at Gisborne when he emphasised the importance of having the fullest notes of the evidence tendered and every point of the evidence clearly established. Mr. Justice Blair told more than one of the witnesses that he was anxious to ensure the utmost clarity, as his notes might have to be perused by members of another tribunal. He also invited co-operation in this direction of the leading counsel for the respective parties.
