COMPENSATION.
WAIHI MINER'S CLAIM. EARNINGS OF A "SCOUT." Reserved judgment was given by the Arbitration Court to-day in a compensation claim by Peter McConnoll, quartz miner, of Waihi, the defendant being the Waihi Gold Mining Co.
The only matter in dispute was the basis of calculation of the plaintiff's average weekly earnings.
The Court said the custom of miners was to work in pairs, and the selection of a "scout" to replace a contractor absent from work was left to that contractor's working mate. For all the purposes of the contract, the scout so selected was regarded as a member of the party of contractors, and his earnings were proportionate to the net earnings of the party for the period during which he worked. The judgment of the Court was that plaintiff's average weekly wages arc to bo assessed, and the average weekly earnings of a "scout"'taken as a basis. The evidence was insufficient for an assessment to be made, but counsel should have no difficulty in arriving at, an agreement as to the average weekly earnings of a "scout." If difficulty presented itself the matter could be brought up again.
