ALLEGED THEFT.
STRANGE DEVELOPMENT.
PRISONER TO GIVE EVIDENCE

HAMILTON, this day.
Theie an extraordinary development. in the Supreme Court this morning in a case in which Henry Tod Scot-t, aged 28, is charged with breaking and entering the dwelling of Mrs. Lawrence Andrews, Claudelands, and stealing a violin in a case, and jewellery, valued at £31, on August 30.
Mr. J. Strang, in opening the defence, informed the jury that a man serving a. sentence at Mount Ivden prison, who was sentenced at Auckland this week, would come forward and say that some time ago he entered a house at Hamilton and stole a violin and jewellerv, which he disposed of to a second-hand dealer for IS/. "I cannot comment 011 this," added counsel "but it may be of value to you in coming to a decision." The judge made a special order for the man to be brought to Hamilton to-dav to give evidence. Mr. Strang said that the defence rested substantially 011 an alibi. This morning the evidence for the defence consisted of hearing a number of witnesses, who stated that Scott was selling art union tickets in Claudelands at the time when it was alleged that the violin and jewellery were sold to a second-hand dealer in Hamilton.
