WIFE'S ADVANCES.
CLAIM AGAINST HUSBAND.
QUESTION OF PRIORITY,
,"Whether a wife had a prior claim over a judgment . creditor in her husband's estate was a point in dispute at the Supreme Court this morning when Jessie May Shepherd (Mr. Hunt) Bought to set aside a charging order which had been granted to Thomas Lace Caley, (Mr. Firilay) against the estate of Henry Thomas Shepherd.
Mr. Hunt said that Shepherd, a builder, was fairly affluent until 1930, from which time until 1933 the household expenses had been provided by his wife, who also made various advances to him, the combined total being £444. Mrs.- Shepherd, in evidence, said that she was making a prior claim over a fund in which her husband was interested—that of his late father. She detailed specific sums, apart from the household expenses, which she had advanced to her husband, and said that she had done so on the. understanding that she was to receive the whole of her husband's interest in bis father's estate. This, on the death of the father, was estimated at £500. The money which she had advanced had been bequeathed her by her grandfather. Cross-examined, witness' said that a note she had obtained from her husband to cover the advances she had made was given her when ehe advanced a .sum of £180.
