CLAIM FOR DAMAGES.
ONEHUNGA RELIEF WORKER. A case involving alleged injuries to a relief worker named Bertie James, came before Mr. W R. McKean, S.M., at the Onehunga Court yesterday afternoon. James (Mr. Wopds) sued the Onehunga Borough Council (Mr. Meredith) for damages amounting to £70 7/6. Mr. Woods said plaintiff had been employed loading trucks with metal at the Onehunga quar%. When the trucks were loaded they were run along a tramline and the metal was lifted into a pit. While James was riding a loaded truck it ran off the rails, and he was thrown out. Several rocks fell on him and injured him. Plaintiff, in hie evidence, said that there was no brake on the truck, and the line was unsafe. He was in hospital for 15 days. Cross-examined, he admitted that he had never been oh a job like that before. Ho had since received compensation for the injuries under the Workers' Compensation Act. Mr. McKean reserved hie decision.
