MISSION BAY ARREST.
ONE CHARGE DISMISSED. "He was more angry than drunk, and being of an excitable nature, used the language complained of," said Mr. F. K. Hunt, S.M., at the Police Court this morning, when Arthur Herbert Eden, aged 53, appeared on charges of being disorderly while drunk and with using obscene language at Nihill Avenue, Mission Bay. The ease was partly heard earlier in the week and was adjourned until this morning in order that the officer on duty at the watchhouse might be called to verify the police statements of accused's conduct when taken there. Constable John Paterson stated that when put in a cell accused made such a disturbance that he had to be transferred to a padded cell. In reply to Mr. Gatenby. counsel for accused, the constable admitted that accused had asked to have a doctor called. Evidence was given by a friend of the accused that the latter had only one drink from the time he met him in the afternoon until they returned to Mission Bay about 10 p.m. The accused drove him there in his ca.r, and they went to bed. He did not hear any disturbance. The charge of being disorderly while drunk was dismissed, while on the obscene language charge Eden was fined £1 and costs. A similar fine was inflicted for trespassing on the trotting course at Epsom during the Christmas meeting.
