CLAIM DISMISSED.
BETTING TRANSACTION. FARMER SUES CONFECTIONER. (By Telegraph.—Press Association.) HAWERA, Wednesday. Alleging that as a result of a betting transaction at Hawera on the Gisborne races in July, 1932, he won £41 10/, but was paid only £22, John Francis King, a farmer, sued William Elder, a confectioner, in the Magistrate's Court to-day to recover £19 10/. King stated that he placed two bets with Elder by telephone. One was £5 on a certain horse, and, if funds, £5 on another liorsc. Both won, the first paying a dividend of £1 13/ on the totalisator, and the other £7 13/. Plaintiff contended that he should have received £46 10/, less the original wager. He denied defendant's suggestion that a limit of £3 15/ was understood. The case hinged on whether Elder was agent for plaintiff or agent for a third person, an alleged bookmaker. The magistrate, Mr. J. H. Salmon, held the latter view, and dismissed the claim under section 69 of the Gaming Act.
