CHARGES DISMISSED.

SEQUEL TO 'PHONE CALL.

STATEMENT NOT SWORN.

Charges of' attempting to obtain liquor valued at £15/ from the proprietor of a city hotel on August 6, by falsely representing that it was for a guest, -were brought against three men, Cyril Percy Hurlc, aged 37, John Martin, 39, and Andrew Sheeran, 32, in the Police Court this morning.

Mr. Tong appeared for Hurle, Mr. J. Terry for Martin and Mr. Hall Skelton for "Sheeran. All three pleaded not guilty. Evidence was gTvcn that a telephone message was received by the licensee of the hotel at 10.30 p.m. on August 0 from a person representing that he was a. man who was staying at the hotel and wanted 6oroe liquor .sent to an address in Nelson Street. The gueet mentioned was with the licensee at the time, and the licensee entered a taxi with another guest and later picked up a constable. They drove to the address given in Nelson .Street, and on arrival they eaw a truck in which were three men. Hurle came across to the taxi and was told the liquor was in the back seat. Looking in, he found a policeman there. The other two accused then dieappeared. Constable J. J. Quirke said he interviewed Hurle in Mount Eden prison on August 8, when Hurle said he wanted to dear the whole matter up. Hurle, in his statement, said he was with Martin and Sheeran on the night of August 8. He denied that he used the telephone, but paid that Sheeran rang someone up. Martin 'was there at the time. Later, Sheeran said he wanted to pick up some "gropr" and pot Hurle to drive him and Martin to Nelson Street. When the taxi drew up, Hurle eaid Sheeran asked hirn to go over to the taxi for a parcel. He did so and looking into the taxi for the parcel, he found a policeman. Hurle said he knew nothing about the matter at all.

Each counsel submitted that there wae no case to answer against his client.

In dismissing the charge against all three, Mr. W. K. McKean, S.M., said the statement made by Hnrle was not given on bath and. therefore was not evidence. ■"' ■
