CLAIM FAILS.
AUCTIONEER'S ENGAGEMENT. PLAINTIFF NONSUITED. The hearing of the claim for £188 10/ damages for alleged wrongful dismissal brought by Ernest A. Gilmore, auctioneer (Mr- Gould), against Produce Markets, Ltd. (Mr. Meredith), was completed before Mr. Justice' Smith yesterday afternoon. Plaintiff was nonsuited. The plaintiff alleged that he had been engaged by James Bell Donald on behalf of the defendant company as auctioneer at £6 10/ per week and that after he had worked for the company from June 10, 1931, to November 20, 1931, he had been wrongfully dismissed. He claimed that though there was no written contract the engagement was for two years. His Honor allowed costs on the lowest scale and made an order for the sum of £84 10/ paid into Court by the defendant company to be taken out.
