PROPERTY RIGHTS. A BY-LAW OPPOSED. OWNERS SEEK REDRESS. (By Telegraph.—Parliamentary Reporter.) WELLINGTON, this day. Claiming they arc suffering a grievous wrong and injustice as a result of the operation of the North Shore Boroughs Water Board's by-law of April 15 last, relative to the protection from pollution of the water supply derived from Lake Pupuke, J. Collins and 50 other owners of laud situated within four chains of the lake's margin petitioned Parliament yesterday for relief. Petitioners, who indicate that all other channels of redress are closed to them, ask for an amendment of the 19-24 Water Supply Act to entitle the owners of land injuriously affected by the 'by-law in question, or other bylaws, to claim compensation on the basis of all euch by-laws being deemed to be a "public work" or a "work" within the meaning of the Public Works Act, 1928. A further amendment is sought to restrain and prohibit the Water Board from making and enforcing other bylaws, rules, or regulations which are likely to cause the rights of owners of freehold and leasehold lands within the watershed to be interfered with or taken from them without adequate compensation. It is stated by petitioners that under the by-law they are prohibited or restricted from, keeping or depasturing stock on properties within a distance of four chains of the lake margin; allowing stock to wade into the lake or be upon the shore; keeping dogs, pigs or poultry; making ditches for the conveyance of drainage; permitting drainage to flow towards the lake; burying refuse "where it is likely to percolate through the soil and contaminate the lake; and erecting new buildings of any kind on any part of the shore. Petitioners contend that for all practical purposes the by-law has deprived them of the full use and enjoyment of their properties, and that as the law stands they have no legal right to claim compensation for the wrongs and injustices they allege they have suffered.
