It was the case in which Jn'rm Isidor Weingott was charsed with, negii gently drremg a. motor car on Mottnt Eden Pond on August 13, thereby causing the death of Henry Lloyd Bartnall, an elderiy man. and in- r"° same manner causing bodily "to his wife, 2araJi Brookhrrfrtinrr DartnalL
The rnafrr evidence was taken on Thursday, the only witness remaining being Mrs. DartnalL aged 69. who is still in hostiitai. "She said her home was in Fendalton, Christchurch. With her husband, she had recently come to Auckland on a visit. Just before the accident witness and her husband alighted from a traniear on Mount Eden Boad, near the BainiGral Boad intersection. When the tram proceeded the/ started to cross the road, and both saw the lights of a motor car coming from the direction of Three Kins®. The
vehicle seemed to he a long way down the road, and witness concluded there was plenty of time to cross. She next remembered lying injured on the road. She had no recollection of being knocked down. She had good sight and hearing, and if the driver of the car had sounded a horn she would have heard in. Her husband was 79 years of age. He had good sight, but his hearing was not good.
Accused pleaded not guilty" and was committed to the Supreme Court for trial, bail ox £L3O being renewed.
