(Auckland) Water Board, held on the loth day of April, 1932, the following Resolution was duly passed :— "In exercise of the powers conferred on it by the North Shore Boroughs (Auckland) Water Supply Act, 1924, and Proclamation of the Governor-General thereunder, issued on the 11th day of January, 1928, published in the Gazette on the 19th day of January, 1925, THE NORTH SHORE BOROUGHS (AUCKLAND) WATER BOARD doth hereby make by way of Special Order a By-law under the said Act and Proclamation, in the words of the draft Bylaw submitted to this meeting, intituled North Shore Boroughs Water Supply Bylaw No. 1, to come into operation on the First Day of July, 1932, and that the Seal of the Board be thereto affixed, and this resolution be confirmed at a meeting -of the Board, to be held in the office of the Commissioner of Crown Lands, North Auckland Land District, Customs Street, Auckland, ou the 13th day of May, 1932, at 3 p.m." The object and purport of the proposed By-law are:— (a) To prohibit the taking of water from Lake Takapuna (hereinafter referred to as "the Lake"), by means of any pump or other mechanical contrivance, excepting under the authority and in pursuance of the terms and provisions of a License issued by the Board and renewable annually ; (b) Prescribing procedure in connection with applications, and the issue and form of Licenses to bo granted to Local Authorities authorising the taking Of water from the Lake for the purposes of public supply, and the form o£ a covenant to be executed by such Licensees with the Board as to payment of dues for water, and observance of the terms of Licenses; (c) Prescribing restrictions upon every Local Authority whose district is within the Water Supply District constituted by the said Act, and which supplies for public purposes water from the Lake in respect of (1) the use upon streets, gardens and lawns of water drawn from the Lake; and (2) waste of water through defective mains and other waterworks; (d) Providing for the issue of licenses (called "Consumers' Licenses") to intending consumers of watei from the Lake, and prescribing the mode of application and the form of such licenses and of a covenant with the Board to be executed by Licensees; (e) Prescribing a scale of charges to be paid by the holders of Consumers' Licenses according to the quantity of water drawn from the Lake, and conditions to be complied with by such Licensees; (f) Prohibiting certain acts in or upon the shore of the Lake tending to contaminate the water or affect its suitability for domestic use; (g) Prohibiting persons owning or having control of dogs, pigs, horses, oxen, or other animals from causing, suffering, or allowing the same to wade in, enter or stray into the Lake or go or be upon the shore; (h) Prescribing conditions to be observed by owners and occupiers of land and others in the gathering area of the Lake; and defining the gathering area by reference to a survey plan deposited at the office of the Board at the Borough Council Chambers, Devonport: (1.) Prohibiting the keeping or depasturing of horses, oxen, or other animals of those species in the gathering area within 4 chains from the margin of the Lake; (j) Prohibiting within the gathering area the keeping of dogs or pigs; erection or maintenance of stables, cowsheds ami piggeries: the keeping of fowls, ducks, ami geese in any housing or enclosure within ) chains of the margin of the Lake; the making or maintenance of cesspools or open ditches for drainage; and the use of any new privy, bath, sink, or sanitary work until properly completed to the satisfaction of the Board and the issue of a certificate of such completion; (k) Prohibiting owners and occupiers of houses, factories and other promises from causing, allowing or suffering the overflow of septic tanks, or the flow of sewage in open drains towards the Lake, or from having sewage in or upon the soil of any land in the gathering area in such a manner or position as to reach, contaminate or endanger the purity of the Lake, and providing penalties for non-repair of sanitary works; (1) Regulating tnc construction and maintenance of new privies and other specified sanitary works within llie gathering area and prohibiting such works unless constructed under permit from the Board and duly completed ; (m) Prohibiting burial or deposit of refuse, rubbish or noxious. noisome or offensive matter where likely to contaminate or affect the Lake; (n) Prohibiting the erection of any new building upon or over the Lake or any part of the shore. (o) Prescribing penalties for offences. (p) Appointing the First day of Julv. 1932, as the date for the said By-law to come into operation. A full copy of this By-law is deposited at the office of the North Shore Boroughs (Auckland) Water Board at the Borough Council Chambers, Devonport, and is open for inspection by the public during office hours uutii the 13th day of May, 1932.
