Comment on Theodore's Refusal

To Give Evidence.

CROWN COUNSEL'S ADDRESS

BRISBANE, August 17,

When the hearing of the Mungana case was resumed to-day Mr. A. D. McGill, in the course of his final address to the jury on behalf of the Crown, commented on the action of Mr. E. G. Theodore, in particular, in not entering the witness box.

Counsel said it should be the one desire of a man holding a high position such as Mr. Theodore's to defend his honour against aspersions of fraud and corruption. His failure to do so must strengthen the inference of his guilt.

Counsel for the Crown have prepared 37 questions for the jury's consideration. The questions bear directly on the evidence.

The hearing was adjourned.
