TKEFT CHARGE FAILS.
CASE FROM PAPATOETOE. In the case in which William Knox, who was charged in the Supreme Court yesterday with .breaking and entering the shop of Thomas W. Donnel, of Papatoetoe, and stealing tobacco, cigarettes, and stores, valued at £3, and alternatively with receiving, the jury returned a verdict of not guilty. " Prisoner was discharged. The offences were alleged to have been committed on the evening of January 28 last. Mr. Noble, for accused, submitted that all that had been proved was that the accused was in possession of goods, which he. said he had purchased at Otahuhu. The Crown had not proved that he did not, and its case was founded merely on suspicion.
