INTOXICATED MOTORIST

With marks on his head, caused, his counsel said, through a fall, an Auckland, business man appeared before Mr P. K. Hunt, S.M., in the Police Court this morning charged with being in a state of intoxication while in charge of a motor car. He pleaded guilty, was convicted and discharged, and had his name suppressed.
Detective Sergeant Kelly said accused was seen driving his .car down Queen Street on Christmas Eve. At that time traffic in Queen Street was prohibited. A constable jumped on to the running board of accused's car. Accused was taken to the police station, and a doctor certified that he had been drinking. Mr. Lovegrove, who appeared for accused, said the liquor was taken purely for medicinal purposes. Accused had come back from Sydney only a few days before, and consequently he knew nothing about the regulations prohibiting traffic in Queen Street on Christmas Eve. He had .gone to a clftb to make some bowling arciangements with a friend, had stayed there about an hour, and, when leaving, had slipped and fallen. Then he fainted. His friend rushed into the bar • and got him a brandy. When he came round ho thought that the brandy might have affected.him, and he asked his friend to drive the car. But the friend had no driving'license and assured accused that he would be quite all right. Evidence following the lines of counsel's statement was given. "I think I can establish a record on this occasion," said the magistrate. .."I will convict and discharge this man. It was not a serious matter. The whole affair was apparently brought on by pure accident, and I will grant counsel's request for the suppression of the name." ,
