CONTRACT RESCINDED.
DWELLING AND GARAGE.
"WORK OF A JERRY BUILDER"
MACHINERY AGENT'S CLAIM.

HAMILTON, this day,
"An inspection of the house as completed goes to show that the job is very far from being a reasonably good one and can only be classed as. the. work of a. 'jerry builder' of the worst kind." Thus reported Mr. F. A. Snell, a well known builder, after inspecting a dwelling and garage erected ,by Osmond Le Page, builder, of Hamilton, for Charles A. Martin, machinery agent.
In consequence of this report Martin sought a rescission of the contract with Le Page and the return of £93, being moneys out of pocket, before Mr. Justice Herdmaii to-day.
The case was undefended. Mr. Strang said that plaintiff had entered into an agreement with Page to buy a section of land from him. A house and garage were to be erected by Page' on the property. The cost of the land and buildings was to be £1032. Plaintiff would state that specifications were to be drawn up and agreed to by both parties, but plaintiff said these specifications had never been submitted to him. Plaintiff further, alleged that the building had been faultily constructed and accordingly he repudiated the contract. Mr. Strang thought he was entitled to describe Le Page as a speculative builder.
Plaintiff said the borough building inspector first called attention to the faulty nature of the construction and materials. When a second builder went to make an inspection he found hiniseli" barred out.
His Honor rescinded the contract and ordered a refund of the money and allowed COStS;
