DAMAGES FOR RATEPAYERS.

CLAIM AGAINST NEW LYNN COUNCIL. Damages amounting to £175 and £25 for trespass and injury suffered to their property were claimed against the New Lynn Borough Council by Henry Green, labourer, and Joseph Radonich, fishmonger, respectively, before Mr. Justice Blair in the Supreme Court yesterday. They alleged wrongful entry upon their land and claimed that damage had been done in laying a sewerage system. The plaintiffs complained that the servants of the council had entered on their property without due notice, had dug trenches and driven sewage tunnels, had left portion of the drains above the level of the land and had spread spoil over their property. It was admitted by the defendants that by an oversight individual notice had not been sent to the plaintiffs, but it was claimed that the scheme had been adequately advertised and the work carried out with care in the usual manner. Green admitted the value of the property would have been increased by a proper drainage scheme, but contended that the sewer had been put in the wrong place. The Court gave judgment for £37 for Green and £8 for Radonich. Costs were allowed on the Magistrate's Court's scale.
