SALE OF EWES.
QUESTION OF WARRANTY,
DAMAGE CLAIM FAILS. (By Telegraph.—Press Association.) MASTERTON", this day. Reserved judgment was delivered thi3 morning by Mr. Miller, S.M., in a case in which A. G. and A. H. Tinkham claimed from J. S. Jessep £470 damages for alleged breach of warranty in connection with the sale of 547 ewes in August, 1928, by defendant to plaintiff. It was stated to be the first case of the kind in Xew Zealand. Mr. Miller said he was satisfied that Tinkham, sen., bought in the usual market ewes which had run with rams •in accordance with the usage of the trade, and that the price was based on a low percentage, and in keeping with the percentage he actually obtained. Having protected himself by fixing this price, he now sought to recover something he did not pay for by saying he had warranty that he was to get a fair percentage. He could not have double protection. Judgment was given for defendant with costs.
