FALSE DECLARATION ALLEGED

SUPREME COURT TRIAL,

"It would seriously affect businessmen if false affidavits could be made in these Courts," declared Mr. V. N. Hubble, who appeared for the prosecution when Julius Barth, a private bailiff, was charged in the Supreme Court this afternoon with, being authorised to make a statement on oath, he made a declaration that would amount to perjury if made in judicial proceedings. The offence, which was denied by accused, was alleged to have been committed at Auckland on November 28, 1928. Mr. Hubble explained that the allegation was that accused made . a false affidavit of service in the Civil Court at Auckland. He stressed the fact that it was important that summonses issued against a person should be served before judgment was given by default against liini. In the present case accused, who undertook to servo summonses in a private capacity, filed an action in the Court by a loan company and said he had served a Mrs. Bamber and a Mr. Green with summonses on November 3. In actual fact, however, he had not done so. Ho had gone to Mrs. Bamber's place on November 6, it would be stated in evidence, and handed her a summons for herself and Mr. Green. He -was informed that the latter waß in hospital and could not bo .seen, and left the summons for him at the house. The whole system of Court procedure depended on the accuracy of statements relative to affidavits of scrvice, said Mr. Hubble, and although in this case Mr. Gfefen got his summons, the false affidavit was made.
