"OUT OF HAND."

ALSO PIG-HEADED.

YOUNG HAN "GOES THE PACE."

PLACED ON STRICT PROBATION.

• Telling him that he deserved to spend six months in gaol, Mr; F. K.'Hunt, S.M., allowed' Frederick Francis Brindle,. a butcher, aged 28, his liberty under supervision, of the probation'officer.

Brindle, for whom Mr. Singer appeared, was in the dock at. the Police Court this morning on'charges of stealing a rim, tyre and tube valued at £5 14/, belonging to some unknown person, on May 18; on - February 6 stealing a car wheel,, rim and i tyre worth £6 11/6, belonging to Michael Keady, and on June ■4 stealing a case of motor spirits valued at. 15/10, the property of Albert Ernest French. . . ■ .

■■" Mr. ■ Singer said accused would plead guilty to the second charge if the other two-counts were withdrawn. The police agreed to this course and only the one charge was proceeded with. -. ,

"This young' man comes of a good family and he has been excellently, brought up," said Mr. Singer. "Unfortunately he fell in with bad companions. It was also his misfortune that he,, was the one man of the three who had money which he has been, spending . freely. Brindle has had several days in Mount Edeni while, on remand, and this, coupled with his father's - appeal to him last week, has taught him a lesson. He has promised to mend his ways and he now has the opportunity of retrieving his mistakes. Brindle has never been before the Court before, and I would therefore ask your worship to place him on probation to see if his promises and his expressed determination is carried out."

Chief Detective Hammond said Mr. Keady and Brindle both bought motor cars from one motor firm at the same time. The two cars were alike and what fitted one would fit the other. The rim, tyre and tube were oh Kcady's car one night, but the next morning they were missing. These parts were later found secreted under a house, Brindle explaining that he had found them. "Brindle is riding for a fall, and he's been going the pace," added Mr. Hammond. "He's also pig-headed and thinks he's just the one. He has been out of hand for some time." i ■ Mr. Hunt: If he had been charged the other clay when I sent Tate, his companion up above, I would have sent Brindle too. I'm. just thinking now about sending him to Mount Eden. Mr. Singer stated that Brindle's father was giving accused a full-time job., Accused was a good worker and would get straight back to work if allowed

probation

"You deserve six months, you know," Mr. Hunt told Brindle. "I know the company you have been keeping. However, I will give you a chance and place you on probation on the very strictest of terms. Yon will be ordered to make restitution and pay £2 10/ witnesses' expenses, and if you break any one condition of your release I will send you up to prison for the maximum term."

Turning to Mr. Singer, Mr. Hunt said. •'Tell him to get rid of that motor car. He has been driving thieves about in it."

Mr. Singer: Yes, sir, he is going to sell his car.
