FARMERS' DISPUTE.
BREACH OF COVENANT. COURT AWARDS £500 DAMAGES. An undefended claim for £.">OO damages was heard by Mr. Justice Reed in the Supreme Court this morning. The defendant, Alfred Horton. farmer, of Opotiki, had filed a defence, but there was no appearance of hint. After the evidence of the plaintiff, Edwin James Eraser, farmer, of Auckland (Mr. Julius Hogben) had been heard his Honor gave judgment, for the amount claimed. The statement of claim said that bv a deed bearing the date February 28, 102'?. defendant agreed with plaintifT that he would at his own expense effect permanent improvements upon certain land at Opotiki to the value of €100 during each year from date and during the currency of a memorandum of mortgage given to the plaintiff and affecting the land in question. Defendant in breach of covenant failed and neglected during each year to effect any permanent improvement whatsoever.
