AUCKLAND MAGISTRATE'S
DECISION REVERSED.
INTERPRETATION" OF AGREEMENT
A decision by Mr. E. C. Cut ten, S.M.. in the Auckland Magistrate's Court was reversed yesterday by Mr. Justice Reed, sitting , in the Supreme Court.
Mr. Cutton had given judgment against Thomas Watts, junr.. tobacconist, of Whangarei ((Mr. A. H. Johnstone), for £102 o/S, for goods sold and delivered to H. Pope. Respondents were the firm of A. H. Nathan, Limited (Mr. Terry).
Watts, who had sold the business to Pope, appealed against the decision, contending that the goods had been purchased by Pope and that credit was given to the purchaser alone.
Giving judgment, his Honor said the case depended entirely upon the construction placed on the agreement between the two parties. He regretted that he could not agree with the view taken by the magistrate. The agreement did not in any way bear out the relation of principal and agent.
His Honor gave judgment for appe! lant with ten guineas costs.
