PURCHASE OF MOTORS.
MAGISTRATE COURT CLAIMS. RESERVED JUDGMENT DELIVERED. Reserve judgment was delivered in the Magistrate's Court this morning by Mr. E, C. Cutten, S.M., in the case in which Trucks, Ltd. (Mr. Goulding), proceeded against R. E. Mackenzie (Mr. Davis), for £70, instalments due under an agreement in respect to the purchase of a motor truck valued at £400. The defendant submitted that it was a condition of the agreement that the truck was in good working order, and suitable for the purpose for which he purchased it. He resisted payment because the truck did not come up to these specifications. After reviewing the facts of the case. lii= Worship said there was no cvidenve that, would justify the conclusion that any misrepresentatiwi was made as to the working condition of the truck, nor a? to its suitability for the defendant's work. Therefore the defendants had no defence on the present action, and judgment would be for the amount claimed. After the third time before the Court, the case in which H. 15. Scott and Co.. Ltd., motor dealers, of Christchureh, took action against F. Worihinprton, general smith, of Auckland, for JEIOO. being the balance owing fer the purchase of a car. was disposed of by another judgment of Mr. Cutten. Judgment was entered for the plaintiff for the sum claimed. The defendant had traded in another car for the one he purchased, this being sold for £350. He admitted the correctness of the plaintiff's figures, but said he nevpr approved of the sale of the car for £350. He contended that it was worth fully £430, and counter-claimed for £100 as an answer to the plaintiffs claim. Judgment was also entered for the plaintiff on the counter-claim. Costs amounted to £26 15/6.
