RECOVERY OF MONET LOW.
INTERESTING JUDGMENT.
(Br -Press ARsodatlojLl NEW PLYMOUTH, Thursday. The Chief Justice delivered judgaeat on points of law in the WaiUra Wttiarr rase, in which Ernest Johnston clained £I*B from Denis George, arising from a betting transaction in which fnrud was alleged.
Two questions were involved— the n>covers bility or otherwise by plaintiff under the Gamin? Act of money lost, and paid by cheque, and the recoverability or otherwise of money from a person carrying on the business of a bookmaker.
The Chief Justice ruled that the noser was recoverable, but that of the tW. action was to a bookmaker and th» money was not recoverable-
The effect of the judgment is that 1« defend the claim successfully Georca mu«t establish that Johnston" was a bookmaker.
