AUCKLAND MAN'S £3000 WIN.

CLAIM UNDER A WILL.

The sequel to the success of an Auckland storeman, Pierce Grace, in a ! Tattersall's eweepstake in 1924, wns heard during an application before Mr. Justice Stringer in the Supreme Court yesterday. Mr. J. Ilogben (for the executors of Mrs. Helen Grace, deceased) said plaintiff (Pierce Grace) became a beneficiary under a certain will, and application was made for maintenance on his behalf, but owing to the fact that p'.nintiff was fortunate enough to win a large sum. approximately £3000, in a Tnttersall's sweepstake, in 1924, he had not pressed the claim. "The original application was made before your Honor," said Mr. Hogben. * "I observe it was," said flis Honor, perusing documents, "but I don't remember the details. It is a rather venerable affair by now." Continuing, Mr. Hogben said in view of the fact that the claim was not pressed, an order for a nominal sum was made, namely one shilling a week. There was a contingency with regard to the payment of costs. His Honor: Has the 1/ a \.eek been paid ? Mr. Hogben: No; it was r-'garded as a purely nominal order. The present action is with regard to costs.
