SHIPMENT OF CATTLE.
CLAIM FOR DAMAGES SUCCEEDS. BURNS. V. BUCKLAND. The action involving a claim for £197 9/6 damages in respect to the shipmentof cattle from Auckland to Nukualofa, Tonga, in August of 1923, which was commenced before Mr. Justice Stringer last .Friday, was concluded yesterday afternoon.
The plaintiff was John Burns and Co., Ltd., merchants, Auckland (Mr. T. N. Holmden), and the defendant was Alfred Buckland and Sons, Ltd., stock agents, Auckland (Mr. Beckerleg).
. The claim was that the defendant company received an order from the plaintiff company to ship ten cattle to Tonga to a Mr. Cowley. The cattle were duly shipped but one died on arrival at Tonga and five others died or had to be killed within a veek or ten days of arrival. Cowley lefueed -to accept delivery and the plaintiff sued him, but the Tongan Court upheld Cowley. The plaintiff then sued Buckland and Sons for damages.
Legal argument occupied all the morning, after which his Honor gave judgment for the plaintiff company on the main claim, and reserved judgment on the question whether the plaintiff was entitled to claim for the costs of the action against Cowley at Tonga.
