Repudiation of his liability for a portion of the commission due on the sale of a Mount Edim house was the allegation brought against John Urqufiart, builder. Boundary Road, Mount Eelen (Mr.-Gould),- by Percy R. F. Thode, laud agent, of Auckland (Mr. T. C. Webster) in a civil action that was heard at the Magistrate's Court before Mr. W. R. MeKean, S.M. In giving reserved judgment to-day, the Magistrate awarded the plaintiff Thode the balance of his commission, namely £26 5/. His Worship said that the house in question was valued at £1375. Plaintiff had been authorised to sell it for that sum, defendant agreeing to pay commission at the usual rate. A prospective purchaser was obtained and an offer made to purchase the house for £1250. This .offer was accepted, defendant holding that he had made it a condition to pay only £10 commission. Plaintiff accepted £10 from defendant, but said that he did not regard it as a complete . fulfilment of defendant's liability to him. The purchaser of the house, a Mr. Roberts, was called to give evidence as to certain conversations in regard to the commission; but, as hi3version was conflicting, the Magistrate found that plaintiff's claim was a good one and awarded judgment accordingly.
