DESTROYED IN TRANSIT.
LIABILITY FOR LOSS. A rather interesting case came before Mr. W. R. McKean. S.M., at the Magis T trate's Court yesterday. G. Haycock and E. McCoskrie (Mr. Sneddeu) sued Mrs. E. Butler (Mr. Burt) to recover £60 13/6 for goods.sold and delivered. The furniture was destroyed by fire when in transit, and the dispute was aa to whose was the loss. As, however, Mrs. Butler had paid railage on the goods, his Worship held that she had accepted delivery of the furniture. Judgment was therefore entered for the plaintiffs with costs. ": ■
