CLAIM FOR GRAZING.
A case regarding payment for grazing came before Mr. W. R. McKean, S.M., to-day at the Magistrate's Court. Lum Low. gardener, of Mangere I Mr. L. K. Munro), claimed from R. A. Do well, of Melrose Road, Mount Roskill, retired farmer (Mr. Bone), the sum of £72 for defendant's use and occupation of certain pasture land leased to the plaintiff, for grazing thereon by defendant of 14 cows and two horses, for which it was alleged no rent had been paid for the period claimed. Mr. Munro said defendant had paid into Court £24. The question was the real value of the use of the land. The area was at present leased at £3 per week. The defendant stated that he arranged to pay 15/ per week and the water rates. He did so for some time to Miss Mitchell, and afterwards to Lum Low. Lum Low told him he could continue on. also not to pay any more rent to him till he asked for it. Mr. McKean said Lum Low could have got possession if he wanted it. Judgment was entered for the plaint. : rt for the £24 paid into Court by defendant.
