LEASE FORFEITED.
COMPENSATION NOT PAYABLE.
The failure of Mrs. J. Craig, who held a lease of a City Council property in Poneonby Road, to make application for a renewal of the lease within three months of Its expiration, ehould be of interest to other lessees of Council property. In the terms of the lease three months' notice of her desire for renewal was required, but Mrs. Craig only gave one week's notice, and asked that the lateness of the notice be waived, and that she be allowed to renew. The City Solicitor at the time reported that the Council had no power to waive the lateness of the notice, and, following this, the Council declined the application. The question was raised by a member of the Council as to whether, if the Council put the lease up for auction,' Mrs. Craig could claim compensation for the buildings erected thereoiu The City Solicitor reported last night that compensation was not payable, and the> lessee, having lost her right of renewal, the property reverts to the Council with all improvements absolutely, Oir-the recommendation of the Parks Committee, it wa« decided that the property be offered by auction for lease at upsets to be fixed by the committee.
