NIGHT AND DAY JOB.
WOT CAUSED BY AWARDS.
INTERPRETATION BY COURT.
Decision was given to-day by Mr. Justice Frazer, of the Arbitration Court, on a most unusual and interesting point, which was referred to him for interpretation. The United Repairing Company employed two men to work from 11 p.m. on one day continuously till after 4 p.m. the next day, and paid them "night rite" from 11 p.m. till 8 a.m., and then ordinary time on till the end of the job at 5 p.m. It was claimed in the Magistrate's Court on the men's behalf that they were entitled to overtime rates from* 8 a.m. onwards, as it was a continuous job starting at 11 p.m. In giving judgment his Honor pointed out that the award did not fully cover the unusual position for night workers, but after traversing the clauses of awards relating to night workers and day workers, he gave his opinion that the men were entitled to what they claimed, namely double rates for all time worked by them between 8 a.m. and 5 p.m.
