TERMS OF AGREEMENT.

COUNCIL AND COMPANY.

POSITION AT TAKAPUNA.

DEED POR EXECUTION.

Deciaion to execute tbe agreement between the Takapuna Borough Council and the Takapuna Tramways and Ferry Company was made at a meeting of the council last evening. The DeputyMayor, Mr. J. W, Williamson, presided. Following the issue of a new Order-in-Council, the borough's solicitors forwarded the deed of delegation for execution by the council. Members were reminded that the agreement bad been signed on May 6 last, and covered the terms on which the Order-in-Council would be delegated. One of the clauses of the agreement provided that the Tramway Company should run a thirtyfive minutes* service from approximately 7 a.m. to 10 a.m. and 4 p.m. to 7 p.m., and an hourly service from 10 a.m. to 4 p.m. and 7 p.m. to 10.45 p.m. The company was also to run a late trip at 11.30 from the city on at least three nights a week. Mr. Sinclair Brown, director of the company, had stated that that service applied only to' business hours. It did not» include Saturday afternoons and Sundays. Mr. Brown also desired that the council be informed that the service was between Bayswater and Sheriff's Corner. The other change in the agreement, continued the letter, was in reference to the cancellation of the deed if the system was not electrified within one year, provided the power was available, or two years from any other cause. Mr. Brown had asked, that a clause be added that any action to rescind the .agreement be taken within six months of the breach. That provision had since been made in the deed.

Tbe deed of delegation, together with the solicitors' explanatory letter, was received by the council last evening. Mr. Brown waited upon the council and further explained the alterations to the deed. He made an assurance that the thirty-five minute service would be made ti Sheriffs Corner and hot only as far as Milford Road. The.company, he said, was at the present time substantially involved, in competition with the buses. With the electrification of the system, the company would be able to provide extra services without further expense. At the present time it was unable to offer anything further than in the agreement. Mr. F. W. Suckling said that he was one of the unfortunate residents from the back of the lake. He was forced to listen to frequent complaint* concerning the service in that part of the district, which, he considered, was unreasonable for a borough like Takapuna. Owing to tbe present time-table, a number of residents travelled on other routes. He had no desire to hold up the deed of delegation, but would like the company to consider the running of a few additional trams around the lake. Mr. P. E. N. Gaudin asked Mr. Brown when the company intended to commence work on the retaining wall at Bayswater wharf, and was informed that following tbe necessary arrangement with the Harbour Board the scheme would be put in band at once. It was finally decided that the agreement, with the alterations as mentioned, be executed under the seal of the council.
