APPEAL AGAINST CONVICTION,

WELUNGTON, this day.
The Court of Appeal was, engage this morning in a case stated . under. section 442 of the Grimes Act, IWB,. from Auckland. Mr. Fair,' "K'.C, appeared' for the Crown, and Mr. R. A. Singer for, prisoners, Francis Archibald Parker and John Ormiston Wood, who were in December last charged with obtaining £6 from the-New. Zealand Dairy Association by representing : that 2s4|lb. of cream had been-supplied to the association for,a stated period by Wood. '
No; evidfence was called on behalf of accused. At the close of the- case for i the Crown, counsel for accused applied to have the first count- against accused withdrawn and the second count against Parker .withdrawn on the ', ground that there was no.',' evidence against him. "■ The application was ;refusedby the judge, who directed the jury that the statement made by Wood _was not evidence against, Parker. , The jury convicted both accused on the first count, arid' on the-Second count they convicted Wo<?d and discharged Parker. Sentence was .deferred, pending the Court of Appeal answering questions as to whether the judge was right in allow-.-ing the case against Parker and Wood' on the first count, and against Parker. op the second count, to go to the jury, and the further question as to whether the conviction on .the first count waa valid.. , '"..''''.
