A PECULIAR CLAIM.
A nonsuit was entered by Mr. F. K. Hunt, S.M. this morning in a somewhat unusual caso. The plaintiff, Mrs. Xovina Mary Scott (Mr. Fennell) sought to recover from Daniel McCarthy (Mr. Jacobson) the sum of £94 14/ as damages, of which £~n was claimed as penrrat damages. Plaintiff stated that on January 12. 1025, defendant came to her place and stated he had paid a deposit on it. and asked permission to enter and start work with painters and paper-hangers. Tt was alleged defendant stated he had her husband's permission. It was further stated that defendant caused plaintiff to remove some furniture, with the result that she suffered severe injuries, and had to receive medical attention.
Mr. Hunt said there might perhaps be a case for damages for trespass.
Mr. Fcnnell said defendant, had no authority to pnter into the house.
Mr. Hunt said the present action was not for trespass but for personal damapes. The plaintiff's story was: "1 moved the boxes, and hurt" myself."'
Mr. Fennell: It was defendant who asked her to move the boxes.
Mr. Hunt nonsuited plaintiff, costs being allowed.
