DAMAGE TO STREET.
LAND OWNER NOT LIABLE. [Sy Own Corre»pqnd«it.) HAMILTON, this day. This morning Mi. Young, S.M., delivered reserved judgment in proceedings recently instituted by the Hamilton Boroug"h Council against Joseph Frear, charging defendant with negligently allowing a retaining wall abutting on a garden to give way or fall so as to injure a public street, in contravention of section 200 of the Municipal Corporations Act. The Magistrate reviewed the evidence at length. He held that the wall and footpath in their present state had been so constructed by the Council itself, and that there was no evidence to show that there had been negligence on the part of the defendant. The information was dismissed.
