HEAVY TRAFFIC.
OPERATION OF A BY-LAW. APPEAL AGAINST DECISION. The vexed question of heavy traffic by-laws was ventilated at the Supreme Court again thie morning, when an appeal from the decision of Mr. R. W. Tnte, S.M., concerning the validity of s by-law of the Whangarei Borough Council was appealed against by James Sellars Willeocks, borough traffin inspector, nf Wliangarei. Appellant was represented by Mr. Stanton. For respondents. James Hardii- and Kdward .T. Hardie, carriers, of Whangarci, Mr. Ostler, with whom was associated Mr. Steadman, appeared. When the ease was heard before the magistrate, deft , ndunts were charged wiili using a vehicle weighing one and ii-half tons laden on a street within the borough liefori , obtaining a heavy trafTic licence. The information was dismissed by Mr Tatc. S.M.. on the grounds that the bylaw was uncertain, unreasonable anil oppressive, and unequal in it, operation. In appealing against the magistrates decision. Mr. Stanton said it was obvious that the real appeal was agwinst the deductions drawn from the facts by the magistrate. Argument was heard at considerable length, and hiy Honor reserved his decision.
