RESORT TO FORCE.

trottole at ohktewai. oseighbours in court. (By TMesrapii.—Own Oorre»pon<lent.) HUNTLY, Friday. A special sitting of the Magistrate's Court was held before Mr. H. A. Young, S.M., yesterday, to clear up a tangle which, had arisen at Ohinewai among three or four parties. About a year ago. Mr. P. Henry leased his flaxmill to Mr. Montgomery on certain terms. .Last winter Mr. Henry waa dissatisfied with the way things were going, and attempted to sell the mill. It was alleged that he went so far as to tell Mr. Montgomery that the mill was sold, and requested him, under the agreement, to pack up and leave. This Mr. Montgomery proceeded to do, but before evacuation was complete, he found that the sale had not been made, and therefore, under the terms o£ his agreement, he was justified in remaining, which he did. Mr. Henry tried to get one of his workmen into a whare thnit belonged to the mill, ,but Mr. Montgomery refused to allow this. The trouble culminated ou a day when Mr. Henry and two others forced the position by entering the whare and establishing a man there. Protests were most vigorous, and a broken window, a lost hat and a lost shirt comprised the damage done. Out of all these circumstances arose an assault charge and two civil cases. In the assault case the magistrate decided that the defendant, although acting under provocation, had gone too far, and waa convicted. He wae ordered to pay costs and £30 compensation for lost time on the part of the injured man. In the civil cases Montgomery was given judgment against Henry for £101 and costs £10 16/, and in the counter-claim Montgomery again succeeded, and waa awarded costs £!) 13/.
