MOTOR CAR REPAIRS.
AN ACCOUNT DISPUTED.
judgment was given this morning at the Magistrate's Court by Mr. W. RMcKean, S.M., in a case brought by John Milne (Mr. F. W. L. Milne) against Messrs. Boag and Simni, !rtd. (Mr. Luxford), to recover the balance of an account for £173 13/4 alleged to be due for repairs to a motor car. The sum of £10S 4/11 was paid into Court by defendant, who contested the balance on the ground that the charges made were excessive.
Mr. McKean said the plaintiff had to satisfy the Court that the charges were fair and reasonable* After reviewing the evidence at some length, his Worship said: "Hearing the evidence, as a whole, jl am of opinion that the claim 'has been shown to be excessive. To what extent it is excessive there is not sufficient evidence before mc to show. The plaintiff will therefore be nonsuited on his claim. The counter claim for goods is admitted, and judgment will, therefore be for the defendant for the amount.
