ASSACLT CHARGE FAILS. After ten minutes' consideration tho jury retiuned a verdict of not guilty in the case of Alfred Brophy (Mr. Singer), a young man who was charged at the ! Supreme Court to-<lay with having ( assaulted flarneft Bennett. Complainant j allesed that as he was passing accused's fruit shop Brophy came out and struck him, breaking his jaw, there being no ' provocation for the blow. For the < defence it was shown that there had 1 been provocation, complainant having ' abused accused previous to the day under jeview. Before the blow was struck 1 complainant had taken off his coat and 1 assumed a threatening attitude. Accused . got his blow in first. Nc explained to l the f'ourt that it had been delivered in ( self-defence. The judge told the jury ." that it they believed accused's story 1 they must acquit him. I Brophy was discharged. 11
