ARBITRATION COURT.
' CLAIM FOR COMPENSATION. '' A claim for condensation for a strained heart aIV-ged to have been caused by carrying a bucket of mortar 1 during the course of his employment, wae brought by John Denni- (Mr! Prendergast) affaiiist lVrcy Thomas Va>w (Mr.. , Leary) in the Arbitration Court yesterday afternoon. It was contended for the defence that the rondition of plaintiff was not due to strain but that he suffered from rheumatism before the accident and bis heart wae affected thereby. Owing to his advanced age hi* body was not in a fit state prior to tho accident, and it was in the same condition now. After heaTing medical evidence, his Honor held that the onus was on plaintiff to prove that the trouble was caused by heavy lifting while in defendant's employ. He had not discharged that I onus, and judgment wae given for defendant.
