THE SMALLFIELD CASE.
CLAIM FOR £ 10,000. GOES TO PRIVY COUNCIL. (By Telegraph. —Press Association.) WELLINGTON, this day. The Appeal Court to-day granted leave ' to appeal to the Privy Council in the National Mutual Life Association versus Smallfield. heard at the last sitting. Security was fixed at £500. The amount involved is £10,000, the claimant being the widow of the late C. I R. Smallfield, stock agent, whose death '■ at Hamilton has already been the subject ;I of considerable litigation. The ground ij of the company's application was that I I the evidence tendered on behalf of Mrs. j Smallfield failed to fu*iish true answers Ij to questions submitted to him on the I proposal for insurance, and had failed ,I to disclose matters .affecting the risk • I which ought to have been disclosed. Mr. ',! Justice Stringer, in his judgment at , ' Hamilton, refused the company leave to • i amend their statement of defence and • I entered judgment for Mrs. Smallfield; ' but the Appeal Court gave judgment by two to one for appellant admitting the new defence.
