CONCERNING A WILL.

.•rIIL'DREX APPLY FOR RELIEF. Under the amendment to the Family Protection Act, an application for relief from the estate of the late Alfred George Pulling was made in the Supreme Court yesterday afternoon by deceased's eon i Mr. Luxford) and daughter (Mr.Gould). Dr. Fitehett appeared for the Public Trustee, executor of the will, and the Attorney-General was represented by Mr. Meredith. In November, 1921, the Public Trustee applied to the court to interpret .the deceased's will, which left the whole of the estate to charities. The court held that the gift was good, and ordered the Public Trustee -and Attorney-General to prepare a scheme for distributing the estate among charitable institutions. In ignorance of their rights the next of kin( had allowed the statutory period in which to obtain relief under the Family Protection Act to elapse. Mr. Luxford intimated his intention to make representation to Parliament to amend the Act to enable relief to be granted to dependents so long as the estafe _ remained undistributed. Mr. Merdifch stated that he did not ivish to oppose the application, as the Attorney-General had considered that if the children could show, when the case ■was heard on its merits, that they were entitled to relief, they should be allowed to do so. Dr. Fitehett also said that he would not oppose the application. Mr. Justice Herdman granted, the applicants leave to apply for relief within 30 days, reserving the question of coets.
