SHARING A HOUSE.

. ■ l Mr. J. W. Poynton. S.M.. heard an application by Mrs.. J. Coleman (Mr. McLiver) for possession of a tenement occupied by Harold Nelson Pollard (Mr. J. .7. Sullivan). The case was -rather involved. It formerly came before Mr. E. C. Cutten. S.M.. who managed to arrange that the tenant should allow the; landlord to occupy some rooms in the house. Meanwhile the tenant paid a deposit upon another house, of which he in turn failed to get possession. He brought the matter before Mr. W. R. McKean, S.M, who refused to make an order to turn the other tenant out. Matters grew worse when the tsvo families failed to agree, after getting joint possession of the first house. Mr. Pollard admitted he had threatened to slap the son of Mrs. Coleman.

.Mr. Sullivan argued that his Worship could hardly turn Mr. Pollard out on to the street when another magistrate had refused an order for possession of the house, upon which he had paid a deposit.

Mr. Poynton said there was undoubted hardship on both sides. It was quite clear that the two families could not continue to occupy the same liouse. Tbe plaintiff was a widow in poor health, and if one family must go. it was only right it should be that of the tenant. Still, as the tenant had not been able to get possession of the house he had bought, he was entitled to* some time. An order was made for possession to be given in six weeks' time.
