OVER AGREEMENT FOR SALE. 0 Judgment for speiific performance of an agreement for the sale of. 101 acres of land w;i3 given by Mr. Justice Adam?; 'at tluo Supreme Court ijesterday in favour of Henry Alfred Mills (Mr. Kiehmond. instructed by Mr. A. (!. I. Bryan), iland agent. Thames, against Thomas Wilson Clotworthy (Mr. Ziman), farmer, Turua. The defendant admitted having signed a form of agreement, but the contention wae that ;io contract was recorded, and that the defendant signed only on condition that the should not become binding unites the defendant approved of the land at a subsequent inspection. The defendant alleged that some of the plaintiffs representations were untrue and declined to purchase. At defendant's solicitor's request hi-s Honor reserved leave to apply for a new trial in four days, the cost of the hearing to be paid by the defendant.
