TROUBLE OVER QUOTATION.

DISPUTE OVER OIL VALVE. Judgment was given in the Magistrate's Court this morning by Mr. W. McKean, S.M.. in the ease in which Phillipps and Impey. Ltd., oil and colour merchants. Queen Street, claimed from Birch and Bradshaw, painters and decorators, Eden Terrace, the sum of £1 13/7. Defendant contended that there was an overcharge of 20/ in connection with' a quotation alleged to have been given, hut plaintiff denied that there was any such quotation. "In all the circumstances," said Mr. McKean, "I must hold that the defendants have not established an agreement to supply at a stated price. The oil for which they charged 12/6 cost them 11/7. Although they may have sold other oils at- a loss at the time, 1 cannot hold that they were bound to sell all these oils at a loss." He accordingly gave judgment for plaintiff for £1 13/7, with costs.
