BOUGHT AT AUCTION.
Mr. J. W. Poynton, S.M.. gave decision at the Magistrate's Court in a claim brought by E. A. Perkins, auctioneer (Mr: Glairter), against F. Glover (Mr. Lenard) to recover £35. Defendant attended plaintiff's auction eale and bought scales and weights far £35. After the sale defendant stated that one of the weights was cracked, and it afterwards fell in two parts. Plaintiff offered to replace the weight, but defendant refused to take the sealer. Defendant now claimed that he did not bid higher than £33. Mr. Poynton said on the evidence he must hold the goods were bought by defendant. The conditions of the sale would compel defendant to take the goods with the defect in the shape of a cracked weight. Judgment wae for the amount claimed with costs, the goods to be delivered to the plaintiff.
