MARRIED THREE YEARS.
S__f AJtATION REFUSED. William A. Heenan (Mr. Osborne Lily) appeared before Mr. J. W. Poynton at the S.-M. Court to-day to answer his wife's plaint for separation, maintenance, and guardianship of two children. ■Mr. R. Matthews appeared for the Society for the Protection of Women and Children. Mrs. Heenan stated they had been ■married three years. There were two children, one aged two yeans and the other five months. Her husband had given her £5 out of his gratuity of £41, and also paid bills amounting to £19. One child was with her husband's mother, and the other with her mother. Cross-examined, complainant said she knew her husband went out to fish at Thames, but could not get any on account of the jelly-fish. Her husband had been in hospital for three weeks, and called to see her as soon as he came out. She wanted a home of her own, but knew it was impossible to get a house in Auckland at the present time. Her husband was not cruel to her.
William Allan Heenan stated that the greater part of his gratuity was expended on paying accounts and for benzine for the fishing launch. He only spent £3 on himself, and sent £2 to his mother. Now he was known on the wharf bo ought to earn from £3 16/ to £4 per week.
Mr. 'Poynton made an order for the payment of 15/ per week for each childmaintenance, also £15 arrears, at the rate of 10/ per week. He refused to grant a separation order, saying a man who had not seen his wife for ftre months must be indifferent to her.
