In the case of Grove v. the Union Company, in the Appeal Court, concerning the non-delivery of apples by the Makura during the epidemic. "Mr. Skerrett Rrffued that the exemption in the bill of ladinst <lid not apply because of the M'akura"s deviation to Sydney before unloading at Auckland. This deviation ■vas not authorised liv t'.ie bill of lading, because it was out of any route customary or otherwise from suva to Auckland, for. as soon as it was sent into quarantine, it came under the dominion of the State, and was pra"t:r-aHv arrested. Tt could not leave without the permission of the State.
