POSSESSION OF A TENEMENT.
QUESTION OT TITLE KAISEID. OWNER NONSUITED. An interesting point was raised at the Magistrate's Court, presided over by Mr. J. W. Poynton, S.M., this morning, when Colin Campbell Biornncki sued Kranei« George "Mills (Mr. J. .]. Sullivan! for possession of a tenement at West Street. Mount Albert, and £01 0/11 arrears of rent. Mr. Sullivan raised the question of tho Court's jurisdiction to try the case, as an agreement was in existence between the parties for the sale of the property. Mr. Ilierna.ki contended that this agreement was .* more ''escrow." and coasoqucntly a nullity, and submitted that tho magistrate did have jurisdiction. Mr. Sullivan submitted authorities in support of his statement, and his Worship accordingly nonsuited the plaintiff.
