INSULTING WORDS ALLEGED.

TWO CHARGES DISMISSED. Charges of having used insulting ■words valculated to cause a bria-m of the peace were brought againut a waterside worker named Thomas install, of Union Street, by Catherine Royal, a married woman, in the Police Court this morning, before Mr. J. lE. WLaoa, S.M.

The words were alleged lo have been used on two separate occasions. The first time on May 29, in Union Stieet, and the other on August 15, in Wellington street. They were set out on the plaint notes as follows: "That thing, your husband." "I know enough about you to hang you." "I'll part you and your husband." "I'll put you up for £50." Mr. R. Singer appeared for the plaintiff, and Mr. J. J. Sullivan for the defendant. Mr. Singer asked that Estall be bound over to keep the peace for the protection of plaintiff. Plaintiff stated that in addition to the •words set ont in the charges defendant only last night had said to her: "Mrs. sniarty, I've got yon for a tenner." This evidently alluded to a judgment rwhich defendant's wife secured againstplaintiff in the ; Magistrate's Court on Tuesday last. Mr. D. W. Wallace said he was present when the words -were used in August, and also last night, and gave corroborative evidence in Tespeet thereto.

Counsel for defendant said that his case would he a denial of the charges. Estall and his wife bad been subjected to a great deal of annoyance from plaintiff. So much so that it had necessitated bringing ber before the Court, and she was fined.

Defendant reviewed his movements on all three occasions 'When the offences were alleged to have taken place, to show that it would have been impossible under the circumstances for him to have committed them. He denied having used any insulting words to Mr 3. Royal ; and said that the evidence in support of the charges was untrue.

Mr. Sullivan: T will leave the matter at that. It is a test of credibility.

His Worship dismissed both Charges, otf the ground that the evidence did not satisfy him in respect thereto. Costs ■were given against the plaintiff.
